Terms & Conditions

These Terms & Conditions (“T&Cs”) govern your use of the services provided by Pinnacle Haulage (“we”, “us”, “our”) to you (“you”, “your” or “the Customer”). By booking our haulage or transport services, or using our website, you agree to these Terms & Conditions.
1. Definitions

“Services” means any haulage, transport, delivery, collection, storage, or related service provided by Pinnacle Haulage.

“Goods” means the cargo, items or freight you ask us to transport.

“Quote / Booking” means our price proposal and agreement (verbal, written, or electronic) for carrying out the Services.

“Carrier” means Pinnacle Haulage or any subcontracted party we use in carrying out the transport.
2. Quotes, Charges & Payment
2.1 Quotes are valid for [X] days (e.g. 30 days) from the date given, unless we notify otherwise.
2.2 The quote includes our charges for transport, loading/unloading as agreed, fuel surcharges, tolls and other standard costs. Any additional costs (e.g. delays, extra stops, waiting time, special handling, customs duties) may be charged separately.
2.3 Payment is due:

for new customers, upon delivery or according to our invoice terms;

for approved accounts, within [X] days (e.g. 30 days) of invoice.
2.4 If payment is late, we reserve the right to charge interest on overdue amounts at [interest rate]% per annum, plus any cost of recovery as permitted by law.
3. Customer Obligations
3.1 You must ensure goods are properly packed, labelled, and safe to transport. We are not responsible for damages arising from improper packaging or labelling.
3.2 You must provide accurate information concerning the nature, weight, dimensions, and special handling instructions of the Goods.
3.3 You must comply with all applicable laws (including customs, import/export, hazardous goods laws) for the Goods.
4. Collection & Delivery
4.1 We will use reasonable efforts to meet collection and delivery times quoted, but times are estimates and not guaranteed unless explicitly stated.
4.2 You must ensure someone is available to receive the delivery or to allow access. If delivery is attempted and no one is available, additional waiting / re-delivery charges may apply.
4.3 Risk in the Goods passes to you upon delivery (or once we have tendered delivery). Until then, we are responsible for loss or damage as described below.
5. Loss, Damage & Liability
5.1 We shall not be liable for loss or damage to the Goods except to the extent that it results from our negligence, willful misconduct, or breach of contract.
5.2 Our liability is limited to the lesser of:

the value of the Goods (as declared and documented);
-
the cost of the Services;
-
a maximum of [£X per kg] or [£X] per shipment (you should define a cap).
5.3 We are not liable for:
-
indirect, special or consequential losses (loss of profits, business interruption, etc.);

damage arising out of poor packaging or labelling by you;

delay caused by third parties, customs, acts of God, weather, traffic, or other events outside our control.
6. Insurance
6.1 You may arrange insurance cover for your Goods at your own cost and risk.
6.2 If you want us to arrange insurance, this must be agreed in writing before transport begins, and additional charges may apply.
7. Subcontracting
We may use subcontractors or other carriers to perform part or all of the Services. When we do this, we remain responsible to you for the performance of those subcontractors under these T&Cs.
8. Cancellation / Variation
8.1 You may cancel or vary the Booking subject to notice:
-
if cancellation happens more than [X] hours/days before the scheduled pickup, there may be a reduced charge or none;
-
cancellations or changes within a short period (e.g. 24–48 hours) may incur full or partial charge.
8.2 We may cancel or vary the service in case of circumstances beyond our control (weather, road restrictions, breakdowns, etc.), giving you as much notice as practicable.
9. Health, Safety & Compliance
9.1 All Goods must comply with safety, legal, and regulatory standards (hazardous goods must be declared).
9.2 Drivers or staff have the right to refuse to carry goods which are illegal, hazardous without declaration, poorly packaged, or pose health/safety risks.
10. Data Protection & Privacy
We comply with UK / EU data protection laws (e.g. GDPR). Our Privacy Policy explains how we collect, use, store, and share personal data.
11. Governing Law & Jurisdiction
These T&Cs are governed by the laws of England & Wales (or Scotland / Northern Ireland, adjust depending on your business).
Disputes shall be subject to the non-exclusive jurisdiction of the courts of [England & Wales] (or where your business is registered).
12. Changes to Terms
We may update or modify these Terms & Conditions from time to time. Any changes will be posted on our website, and will apply from the date of posting. Continued use of our services after changes means you accept the new T&Cs.
